At Secure AI Systems LLC (the “Company,” “we,” “our” or “us”) we are committed to protecting the privacy of Members on our Online Platform and, in furtherance of that mission, have developed this PRIVACY POLICY & NOTICE OF COLLECTION (this “Privacy Policy”) to demonstrate our commitment to protecting your information in our capacity as a data controller and covered business in the normal course of our online business and AI activities. Please note that this Privacy Policy governs your online access as a user and Member to our AI platform, https://secureaisystems.ai, and any related mobile application(s) or other domains we may offer for our Platform Services (collectively our “Online Platform”). Accordingly, this Privacy Policy describes to you what information we collect (including your inputs and Member content), how we may use your information, with whom we may share your information, your rights with respect to information we gather and process, and how you can exercise your rights or prevent unauthorized disclosure of your information.

PLEASE READ THIS PRIVACY POLICY CAREFULLY, WHICH ALSO SERVES AS A NOTICE OF COLLECTION FOR ALL INFORMATION YOU SUBMIT, BEFORE ACCESSING OUR ONLINE PLATFORM OR OUR PLATFORM SERVICES. BY USING OUR ONLINE PLATFORM OR SUBSCRIBING TO A MEMBERSHIP FOR OUR PLATFORM SERVICES, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY.

ABOUT OUR ONLINE PLATFORM & MEMBERS.

Our Company and Online Platform are built around a simple belief: that artificial intelligence (AI) should empower people, not exploit them. To support that belief, we build and maintain private AI nodes, which act as self-contained compute environments that operate without cloud dependencies, telemetry, or data mining. Every AI node on our Online Platform is physically isolated, encrypted end-to-end, and professionally maintained for maximum privacy, reliability, and performance of our Members. The buildout, maintenance, and delivery of these nodes to you through our Online Platform constitutes our “Platform Services”—a term you will see used throughout this Privacy Policy and our Terms of Service. When you visit our Online Platform to access or use the Platform Services as a Member (or simply as an observer looking to demo or investigate our Online Platform), we are generally the controller of information and data we collect (if such information can identify you), and we will use and process it in accordance with this Privacy Policy and our separate Terms of Service, available at https://secureaisystems.net/terms.html (our “Terms of Service”).

As you review our privacy practices below, the type of information we may collect (and use to deliver our Platform Services) is based on your user engagement as a subscribing “Member” to the Online Platform.

1. INFORMATION WE COLLECT ABOUT YOU; YOUR INPUTS.

When you access and interact with our Online Platform, we may collect limited personal information or data that can potentially identify you, as described in more detail below, doing so for the purpose of subscribing you to the Platform Services and supporting your access. In addition, our secure AI nodes within the Platform Services may collect personal or non-personal information and data that does not identify you, depending upon your inputs, prompts, and other content submitted through the Platform Services. But in all instances of collection for your secure use of the Platform Services, we stress that your Member content, AI inputs, and prompts are localized to your assigned AI node within the Platform Services, and not accessible by the Company or third parties.

1.1 Information the Company may gather. With respect to our collection efforts, we may collect the following limited information or data about you when you voluntarily create your Membership profile and continue to access and subscribe to use our Platform Services:

  • Account Information. Name, email, phone number, account credentials and membership level, and your transaction history, doing so for purpose of activating your subscription as a Member and monitoring that subscription.
  • Member Communications. In your use of the Online Platform as a Member, we may also gather information, including name, input information, and account details, if you submit inquiries or help requests to our support personnel through email or other means (see our admin contact information below).
  • Payment and Billing Information. If you use our online payment system to subscribe to the Platform Services, we may use our third-party processors (such as PayPal or Stripe) to collect your payment details and information.

1.2 Information and inputs you submit through the Platform Services. When you use our Platform Services, our AI nodes may securely collect the following types of information or data about you:

  • Member Inputs and Content. By design, our secure AI nodes within the Platform Services collect inputs that you submit, which may include personal information or data if you elect to disclose those details. However, in all instances of collection through these AI nodes, we stress that your Member content, AI inputs, documentation, images, and other prompt submissions are localized to your assigned AI node within the Platform Services, and not accessible by the Company or third parties. Moreover, we do not train or fine-tune our Platform Services and models based on your inputs or submissions to your secure AI nodes.
  • Essential Tracking Technologies for Sessions. To assist and provide a minimum level of operation for your Platform Services, your sessions on the Online Platform may be subject to minimal Tracking Technologies and cookies (which facilitate your continuing access to your secure AI nodes and previous searches or inputs).

Unlike many common industry participants in AI, we DO NOT collect device information, analytics or usage data, or robust log data. Instead, our minimal operational logs for access to the Platform Services are retained in a secure manner and designed in a way to protect the privacy of your sessions in any AI node.

WE DO NOT SELL OR TRADE ANY OF YOUR DATA, AND YOU ARE NOT REQUIRED TO PROVIDE PERSONAL INFORMATION TO US WHILE USING OUR ONLINE PLATFORM (FOR EXAMPLE, THROUGH DISABLING OR BLOCKING ALL TRACKING TECHNOLOGIES). However, if you choose not to provide us with certain account information, you may not be able to fully access our content, Platform Services, or submit inputs through our AI nodes.

WE DO NOT DIRECTLY COLLECT (OR EVEN REQUEST THAT YOU SHARE) INFORMATION THAT IS CONSIDERED SENSITIVE OR HIGHLY PROTECTED UNDER DATA PROTECTION LAWS. IF YOU ELECT TO SUBMIT SENSITIVE INFORMATION THROUGH YOUR USE OF THE PLATFORM SERVICES, YOU DO SO AT YOUR OWN ELECTION, AND IT WILL BE HELD IN A SECURE AND PRIVATE MANNER IN YOUR AI NODE, WITHOUT EXPLOITATION BY THE COMPANY OR THIRD PARTIES.

2. USE OF TRACKING TECHNOLOGIES (COOKIES).

In order to support your submission and input history through the Platform Services, we may use, in our reasonable discretion, essential tracking technologies, collection systems, and cookies (collectively, “Tracking Technologies”) localized within your secure AI node, to collect personal and non-personal information from your device based on your activity, doing so according to this Privacy Policy. We stress that only essential and minimal Tracking Technologies are used by the Company.

As you may already know, Tracking Technologies retain information about your activity on a specific online location to disclose that information to the owner of the applicable webpage or mobile application. When you access our Online Platform, our AI nodes may use essential Tracking Technologies to follow your usage of the Platform Services to facilitate your later sessions and ongoing use. But in all instances, in a secure and private manner.

You may choose to opt out of certain Tracking Technologies by modifying your browser and device settings. If you do so, however, some of the information or content on our Online Platform may be inaccessible or function in a limited capacity. WE RECOMMEND YOU REVIEW YOUR DEVICE SETTINGS TO CONFIRM IF TRACKING TECHNOLOGIES HAVE BEEN PROPERLY DISABLED OR CONFIGURED TO YOUR PREFERENCE.

3. PURPOSES FOR WHICH WE MAY USE THE INFORMATION WE COLLECT.

We collect, use, and process your personal and non-personal information to pursue our legitimate business interests in (i) promoting a secure AI environment for our Members and (ii) performing our ongoing contractual obligations with you on the Online Platform (according to our separate Terms of Service). In furtherance of those purposes, we may use the information that we collect about you to:

4. HOW AND WITH WHOM WE MAY SHARE YOUR INFORMATION.

By design, we do not share your information outside of the Company unless doing so is strictly necessary to process payment or subscribe you to the Platform Services (as noted below). Moreover, your secure AI nodes (including all inputs and prompts you share when accessing those nodes) will not be shared with the Company or third parties, and all of our models are locally hosted, static builds that will not train on your content, submissions, or inputs.

4.1 With our Support Team (for limited purposes). We may share your account information and data shared during the subscription process with our support personnel, developers, and service providers who need such information to authenticate your log-in to the Online Platform and process your payment. In addition, when you contact the Company for assistance, our team and administrators of your account may access your information to promptly respond to you. Otherwise, we do not share your personal information for commercial purposes with others.

4.2 For Legal Purposes and to Defend our Rights. We may also share personal information from our Online Platform if we believe in good faith that doing so is required by law (including under applicable regulations governing the ethical use of AI) or is otherwise required to exercise or defend legal rights, take precautions against liability, protect the rights of any individual, protect the integrity and proprietary rights of the Online Platform, protect the Platform Services or others from fraudulent or unlawful activity, or defend against third party claims (including claims under our Terms of Service).

4.3 In Connection with a Business Exit. We may also share your personal information and data as part of a sale, merger or change in control, or in preparation for any of these events that impact the Company. Any other entity that acquires the Company or part of our business will have the right to continue to use your information and data available on the Online Platform, but only in the manner set out in this Privacy Policy unless you agree otherwise. In all such circumstances, any proposed acquiror of the Company will be strictly bound by confidentiality obligations with respect to your information.

5. YOUR RIGHTS CONCERNING YOUR PERSONAL INFORMATION.

5.1 U.S. Consumer Rights. Pursuant to applicable U.S. data protection and consumer privacy laws, you may contact us to request the exercise of certain rights concerning your personal information, including the right to: (i) request that we disclose the categories and specific pieces of personal information we have collected and disclosed about you; (ii) confirm and know whether we have processed or sold your personal information; (iii) request information about the Company’s disclosure procedures (if any) of personal information; (iv) opt-out of the Company’s data procedures or object to how we process your data (which may require you to end your subscription); (v) request that we provide a copy of, or provide another means of access to, your personal information to you (data portability); (vi) request that we update your personal information or correct any inaccuracies you have detected through your use of the Online Platform; or (vii) request that we otherwise delete your personal information. You also have the right to lodge a complaint with a supervisory authority if you believe we have breached the terms of this Privacy Policy with respect to your personal information. Depending on where you are located, some of these rights may not apply or may be subject to limitations. For example, we may limit the number of requests you make or charge reasonable fees as legally permitted. YOU WILL NOT FACE DISCRIMINATION FOR EXERCISING YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION.

5.2 Exercising Your Rights. You or your authorized representative may contact us (at the administrative information below) to exercise these rights set out above. Your request must provide sufficient information that allows us to reasonably verify you are the data subject about whom the request is made and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

5.3 Opt-out Instructions. If you wish to opt-out of certain features of the Online Platform, terminate your subscription, or stop our Tracking Technologies (as limited as those are), please contact us at the information set out below and we will provide instructions or clarify whether such request is within the scope of our current features.

6. AGE RESTRICTIONS.

Our Online Platform (and the Platform Services) are not generally intended for persons under 18 years of age, in accordance with state and federal consumer privacy laws. Moreover, if you are a Member subscribing to our Platform Services, you must be of the legal age of majority in your jurisdiction to subscribe with us (which may be substantiated through their payment information at the time of subscription). If you are under the age of 18, please do not provide any personal information to the Company through the Online Platform or access the Platform Services. We do not knowingly collect personal information from anyone under 18 without appropriate parental or legal guardian consent. If you believe we may have collected information from or about a person under 18 without parental or guardian consent, please notify us immediately at the support email listed below in Section 10.

7. VISITING OUR ONLINE PLATFORM FROM OUTSIDE THE UNITED STATES.

Please be aware that if you visit our Online Platform from any jurisdiction outside of the United States, your information may be transferred, stored, and processed in the United States—which primarily serves as the main location of our data servers. Data protection and other consumer laws in the United States might not align with those in your jurisdiction, even in light of the consumer rights we have disclosed above. By accessing the information on our Online Platform, you understand that your personal information and data may be transferred to our facilities and to those third parties with whom we share the information, as we’ve previously explained in this Privacy Policy.

8. DATA RETENTION PERIOD & SECURITY MEASURES.

As a Member, you retain all rights and ownership in your information and data shared through the Online Platform (including within our secure AI nodes). As such, the Company and our secure AI nodes only retain your information and data for a reasonable period to fulfill the purposes for which we collected it (as outlined in this Privacy Policy), including to defend our rights under the Online Platform and the Platform Services. If we no longer reasonably need personal information for such purposes or you elect to terminate your access to the Platform Services, we will, at our election and in accordance with applicable data protection laws, delete it from our records, anonymize the personal information consistent with best industry practices, or archive the personal information in a manner consistent with industry standards for protection and retention of personal information, unless applicable law or legal considerations necessitate a longer retention period (as the case may be). If your use of the Platform Services includes retention of your inputs and submissions, you can request that we delete those stored logs and data at any time from the secure AI node in which they are stored.

We strive to maintain technical and organizational measures to protect your personal information and data against loss, misuse, and unauthorized access. For example, we have adopted HTTPS/TLS encryption via a hardened reverse proxy, maintain access control via login credentials in line with industry standards, govern our Platform Services in a way that does not create cloud access, telemetry, analytics, or external APIs, and offer user-specific encrypted memory partitions for your access (among other reasonable protections). Even with these efforts, we cannot guarantee the complete security of these measures, so please exercise caution when submitting personal information online, including through our Online Platform.

9. CHANGES TO THIS PRIVACY POLICY.

We may update or change this Privacy Policy from time to time based on modifications in law or internal review of our policies and procedures. When we perform an update, we will amend the “last updated” date above and notify you if such changes materially affect your rights or our obligations under this Privacy Policy. If you continue using our Online Platform after the Privacy Policy has been updated, you will be considered to have accepted the new terms.

11. PRIVACY MATTERS FOR SUBSCRIBING BUSINESS ENTITIES.

If you are subscribing to our Platform Services as a business entity, or a representative on behalf of a business entity, we note that the terms of the Privacy Policy are only intended for natural person Members and end users, for whom we process data as their direct contact and data controller. For provisions concerning our processing of your personal data or information through the Online Platform on behalf of business clients or organizations you are a part of (in our capacity as a service provider or processor at their request), please refer to the data processing terms of our Terms of Service. In such a scenario, we may be required to forward any data requests we receive from authorized users of the subscribing business client (who is our ‘Member’) to the client’s admin team for handling and response, in accordance with applicable consumer privacy laws.
